This Terms and Conditions / User Agreement is a legal agreement between FEAST Software Pvt. Ltd. ("Company") and the user ("User" or "You") of the EnggOnline web app, associated virtual reality applications, and services provided by the Company. The term "Applications" in this Agreement refers collectively to the EnggOnline web portal, the EnggOnline VR Hub desktop application, and any other VR applications accessed through them.
By accessing or using the Applications provided by the Company, you agree to be bound by the terms and conditions of this Agreement.
If you do not agree with these terms, please do not use the Applications.
a. The Company provides the EnggOnline web app and associated virtual reality applications that enable users to access and interact with engineering learning content and virtual environments.
b. The Applications include features such as course and package management, VR module delivery, learning progress tracking, user and client administration, virtual reality simulations, interactive experiences, and communication tools.
a. The Company grants you a limited, non-exclusive, non-transferable license to use the Applications solely for your personal or internal business purposes.
b. You may not sublicense, sell, modify, distribute, or otherwise exploit the Applications without the Company's prior written consent.
a. You agree to use the Applications in compliance with all applicable laws, regulations, and this Agreement.
b. You may not use the Applications to engage in any unlawful or prohibited activities, including but not limited to:
a. You may provide personal information such as your name, contact details, location, and profile picture through the Applications. You are responsible for ensuring this information is accurate and up to date.
b. Any feedback, queries, or communications you submit to the Company through the Applications may be used by the Company to improve its services. The Company will handle such submissions in accordance with its Privacy Policy.
a. You retain ownership of any content, including but not limited to images, videos, and text, that you create, upload, or transmit through the Applications ("User Content").
b. By submitting User Content, you grant the Company a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such User Content for the purpose of providing and improving the Applications.
a. The Applications provide access based on assigned user roles. Roles include, but are not limited to, learner, client administrator, and platform administrator. Your access to features and content is determined by your assigned role.
b. Learners may access courses, packages, and VR modules assigned to them by their organisation or client administrator.
c. Administrators are responsible for managing users, assigning content, and ensuring compliance with this Agreement within their organisation. They must not grant access to unauthorised individuals.
a. The Company collects and processes personal data in accordance with its Privacy Policy, which is incorporated by reference into this Agreement.
b. By using the Applications, you consent to the collection, processing, and storage of your personal data as described in the Privacy Policy.
a. All intellectual property rights in the Applications, including but not limited to patents, copyrights, trademarks, and trade secrets, are owned by the Company or its licensors.
b. You may not use the Company's trademarks, logos, or branding without the Company's prior written consent.
a. The Applications are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied.
b. The Company disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
a. In no event shall the Company be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use the Applications.
b. The Company's total liability under this Agreement shall not exceed the amount paid by you, if any, for the use of the Applications.
This Agreement shall be governed by and construed in accordance with the laws of The Republic of India, without regard to its conflict of law principles. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of The Republic of India.
The Company reserves the right to modify or update these terms at any time. Your continued use of the Applications after any such changes shall constitute your acceptance of the modified terms.
The Company may terminate this Agreement at any time for any reason without notice. Upon termination, all licenses granted to you under this Agreement shall immediately terminate.
